Terms & Conditions - Nokia Main Bhi Promotion "Contest"

The following terms and conditions applicable

General Terms of the Contest:

1. All persons residing in India of the age 18 years and above as on 1st March 2010 who have entered the Nokia Main Bhi Coach Promotion (hereon after referred to as the "Contest") shall be eligible to participate in the Contest.
2. Nokia reserves the right to amend, withdraw or revise the conditions, and/or prizes as defined for the Contest at any time without giving any notice and in such event Nokia shall not have any liability whatsoever.
3. The Contest is optional and valid for customers (hereon after referred to as "Participant") who register with Nokia India Pvt. Ltd. (hereon after referred to as "Nokia") by sending an SMS with the code "Coach" to 966-4-555-555 from their own mobile number, or submitting their details for registration at http://www.kkrcoach.com/ ( or kkrcoach.mobi/verifyregistration.aspx) between 1st March, 2010 and 19th April, 2010. Nokia can curtail or extend the Contest Period, as it deems necessary.
4. The participants shall follow the instructions of the mobile or online registration form carefully and enter the necessary details as mentioned to be eligible for this Contest.
5. Participants registering into the Contest shall be deemed to have made been made fully aware and accepted all terms and conditions in case you choose to register for the Contest.
6. By submitting your information in the registration form over the internet, wap or mobile, you hereby agree and consent to Nokia retaining and using all the data/information submitted by you in the registration form for sales, marketing and promotional purposes and to furnishing of such data/information to Nokia affiliates and its agents for such purposes.
7. All communication with regards to the Contest will be sent by SMS and/or by email to the registered mobile number or email address indicated in the registration form and it is the responsibility of the member to inform Nokia about any change in his/her details. All communication will be deemed to have been received by the member and Nokia bears no responsibility for communication not received on the mobile number or email.
8. Nokia shall have the right to cancel this Contest at any time without having to give any justification or reason.
9. An employee, agent or a relative of an employee of Nokia shall not be eligible to participate in the Contest.
10. Nokia does not make any commitment, express or implied, to respond to any feedback, suggestion and, or, queries of the Participants or furnish reasons for inclusion and, or, exclusion of any particular submission of the Participant at any stage of the Contest.
11. Nokia may assign any or all of its rights under these Terms and Conditions to its Affiliates without consent of the Participants.
12. Participation in the Contest shall be construed as an acceptance of the Terms and Conditions stipulated herein.
13. Any breach or default by a Participant of any of the Terms and Conditions herein shall result in immediate disqualification without notice.
14. The Nokia officials engaged in the organization and management of the Contest, including its directors, officers, partners, employees, consultants and agents are under no obligation to render any advice or service to any Participant in respect of the Contest.
15. Any attempt by a Participant to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of Criminal and Civil Laws and should such an attempt be made, Nokia reserves the right to seek damages from any such Participant to the fullest extent permitted by law.
16. Following will be the prizes available for eligible winners as defined under the Contest on a announced on a weekly basis:
    (i)  Music Vouchers to be won on registration (available till Stocks Last)
    (ii) Tickets for all Kolkata Knight Rider Matches scheduled
    (iii) KKR Goodie Bags
    (iv) KKR Memorablia
    
17. All selected Participants eligible for the prize shall be informed individually by SMS and by calling the registered mobile number. However, there shall be no liability on Nokia in the event such message does not reach such Participants on any account whatsoever.
18. The decision on the Participants selected by Nokia shall be final and binding and no correspondence or communication shall be entertained in this regard.
19. Nokia or its affiliates shall be entitled to use, in any manner, the name, photographs and other details of the Participant or any other participating person, likeness and status in any publication including the Prize awarded to them, if any. By participating in the Contest, all Participants hereby agree to the same. Nokia may, at its discretion, choose not to disclose the identity of the selected Participant to other Participants.
20. Prize(s) shall neither be transferable nor exchangeable for cash or otherwise. Mere participation in the Contest shall not entitle a Participant to the Prize. No other person or agent can claim the Prize on behalf of the Participant.
21. In the event the Prize involves manufactured items, these shall be subject to manufacturer's terms and conditions for warranty, service and maintenance, and Nokia does not accept any responsibility for the same.
22. Subject to any applicable law (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed by Nokia including, but not limited to, meeting of the Participant's requirements or aspirations, timeliness, security, the results or reliability of any scheme, or the delivery, quality, quantity, merchantability, fitness for use or non infringement in respect of any goods, services, benefits or awards acquired or obtained through the Contest or any transactions effected through the Contest; (b) The Participant expressly agrees that his/her participation in the Contest offered by Nokia is at the Participant's sole risk and is governed by the Terms and Conditions herein; and(c) No advice or information whether by representations, oral, written or pictorial derived from the website or through the Contest shall be construed to mean the giving of any warranty of any kind by Nokia.
23. Nothing in the Contest shall affect any intellectual property rights of Nokia in any product or service, which may be the subject matter of the Contest.

Terms of Participation

24. On registering into the Contest, the participant will automatically receive daily sms messages/alerts on the mobile number registered in to the Contest till the end of the contest period. In case you do not want to receive messages anymore, we respect your wishes. All you have to do is SMS UNSUB to 966-4-555-555.
25. Further, any complaints/grievances'/claims, whether legal or commercial with regard to the said SMS Messages service shall not be entertained by Nokia. Nokia and its agents are hereby being indemnified from all complaints/grievances'/claims whether legal or commercial by participant for all messages that are sent through 966-4-555-555 to the participant's mobile number.
26. To participate in this Contest, the participant will need to respond via SMS to these messages/alerts, the participant will score runs in the Contest every time the participant responds via SMS.
27. On participation the participant will earn runs. These runs can be accumulated to achieve milestones in the Contests defined by Nokia.
28. On achievement of the defined milestones, the participant will become eligible for prizes as defined by Nokia in the Contest.
29. Participants willing to send a SMS to any number mentioned in this website have to bear the cost for the same. Respective Operator charges will be applicable and payable by participant.
30. Nokia is not liable for any and all other costs or expenses in relation to the Contest which are to be borne by the participant personally including, without any limitation applicable taxes as defined by the government.

Terms of Fulfillment:

31. All participants eligible for the gifts/prizes will receive the same on the address and city information mentioned in the online form at the time of web registration. Nokia will not be held liable for any incorrect delivery due to wrong/incorrect mailing address mentioned in the registration form.
32. Participants submitting their information for registering into the Contest will do so at their own risk. Nokia shall not be held liable to the participant in any manner for any reason whatsoever. Nokia presumes that the mobile number, email address, and the information provided by the participant are correct. Nokia will not be responsible for any errors in this respect in any manner.
33. Nokia shall have the right to replace, cancel or withdraw the gifts/prizes offered in this Contest at any point of time during the Contest period without any explanation.
34. Nokia is not liable for any and all other costs or expenses in relation to the Contest which are to be borne by the participant personally including, without any limitation applicable government taxes to be borne by the participant eligible for the gift/prize.
35. Nokia is not liable for any loss or damage of any nature whatsoever if incurred in connection with the Contest, except for any liability which cannot be excluded by law.
36. Please do not sign up for this Contest if you do not agree to any of the terms and conditions specified above.
37. Any disputes arising in relation to the Contest and the gifts/prizes shall be governed by the laws of the Republic of India and the exclusive jurisdiction of the courts of Delhi.
38. Nokia also reserves the right to withdraw or discontinue the Contest at any stage without any liability whatsoever to the Participant and, or, anyone.
